The Subclass 491 visa supports skilled migration to regional Australia where labour shortages exist. You must receive nomination from a state or territory government, or sponsorship from an eligible family member living in a designated regional area.

This visa operates under the General Skilled Migration (GSM) program and uses a points-tested system. You need to submit an Expression of Interest (EOI) and meet minimum eligibility criteria, including age, English proficiency, skills assessment, and occupation requirements.

Key benefits include:

  • Full work rights in a designated regional area
  • Ability to include eligible family members
  • Access to Medicare (subject to eligibility)
  • A clear pathway to permanent residency

Regional areas include most locations outside Sydney, Melbourne, and Brisbane. You must live and work only in designated areas while holding this visa.

491 Visa Duration and Conditions

The Subclass 491 visa is a five-year provisional visa. During this period, you must live, work, and study only in a designated regional area of Australia.

You cannot apply directly for permanent residency through this visa. Instead, you must comply with specific conditions attached to it.

Common conditions include:

  • Residing in a designated regional area
  • Meeting minimum taxable income thresholds for a set number of years
  • Complying with nomination or sponsorship obligations

If a state or territory nominates you, you must meet any additional commitments agreed to during nomination. Failure to comply with visa conditions can affect future visa applications.

Processing times and nomination availability vary by state or territory. Some nomination streams may close once allocation limits are reached within the program year.

Pathway to Permanent Residency

The Subclass 491 visa provides a pathway to permanent residence through the Subclass 191 Permanent Residence (Skilled Regional) visa.

To qualify for the 191 visa, you must:

  • Hold a valid Subclass 491 visa
  • Live and work in a designated regional area
  • Meet the required taxable income threshold for at least three income years
  • Comply with all visa conditions

You do not need ongoing nomination at the permanent stage. However, you must demonstrate that you satisfied regional residence and income requirements while holding the 491 visa.

Once granted permanent residency, you gain unrestricted work and residence rights across Australia.

491 Visa Eligibility Requirements

To qualify for the Subclass 491 visa, you must meet strict criteria covering your occupation, skills assessment, nomination, age, English level, and points score. You cannot receive an invitation to apply unless you satisfy each core requirement at the time of invitation.

Occupation and Skills Assessment

Your occupation must appear on the relevant skilled occupation list for the Subclass 491 visa. The occupation must align closely with your qualifications and employment history.

You must obtain a positive skills assessment from the authorised assessing authority for your occupation. The assessment must be valid at the time you receive your invitation.

Assessing authorities review your:

  • Formal qualifications
  • Employment history
  • Registration or licensing (if required)

You must also be under 45 years of age when you receive your invitation to apply. In addition, you must demonstrate at least Competent English, which generally means:

  • IELTS: minimum 6.0 in each band, or
  • PTE Academic: minimum 50 in each component

Higher English scores can increase your points test result.

Nomination by State or Territory

You cannot apply for the Subclass 491 visa without nomination. A state or territory government must nominate you, or an eligible family member living in a designated regional area must sponsor you.

Each state and territory sets its own nomination criteria. These often include:

  • Commitment to live and work in a specified regional area
  • Employment in your nominated occupation
  • Minimum work experience
  • Evidence of employability or a job offer

You must submit an Expression of Interest (EOI) through SkillSelect before seeking nomination. States and territories assess your EOI and may invite you to apply for nomination.

If nominated, you must live, work, and study only in designated regional areas for the duration of the visa. Failing to comply can affect your pathway to permanent residence through the Subclass 191 visa.

Points Test Criteria

The Subclass 491 visa is a points-tested visa. You must score at least 65 points, although competitive occupations often require higher scores.

Points are awarded for:

  • Age
  • English proficiency
  • Skilled employment (Australian and overseas)
  • Educational qualifications
  • Australian study
  • Specialist education
  • Partner skills
  • Nomination or sponsorship

State or territory nomination provides 15 additional points, which can significantly improve your ranking.

You must ensure that the claims in your EOI match your supporting documents. If your actual score falls below the invited score, your visa can be refused.

Application Process

You must secure nomination or eligible family sponsorship, meet the points test, and follow a structured online process through SkillSelect and ImmiAccount. Each stage requires accurate information, supporting evidence, and strict timeframes.

Expression of Interest (EOI)

You start by submitting an Expression of Interest (EOI) through SkillSelect. This is not a visa application; it signals that you want to be considered for the Subclass 491 visa.

In your EOI, you provide details about:

  • Your nominated occupation (must be on the relevant skilled occupation list)
  • Your skills assessment outcome
  • Your English language test results
  • Your employment history and qualifications
  • Your claimed points score

You must claim points only for factors you can prove. Authorities will assess your claims when you lodge the visa application.

To apply for Subclass 491, you need either:

  • Nomination by a state or territory government, or
  • Sponsorship by an eligible family member living in a designated regional area.

States and territories have their own eligibility criteria and occupation lists. You must check their specific requirements before submitting or updating your EOI.

Invitation to Apply

You can only apply for the 491 visa after you receive an invitation to apply.

If a state or territory nominates you, or if your eligible relative sponsors you, and your EOI ranks competitively, you may receive an invitation through SkillSelect. Invitations are limited and based on points ranking and nomination quotas.

Once invited, you typically have 60 days to lodge your visa application online through ImmiAccount. You must:

  • Confirm all details in your EOI
  • Upload supporting documents
  • Pay the visa application charge

Your application must match the information in your EOI. If the Department finds inconsistencies or inflated points claims, it can refuse your visa.

Document Checklist

You must provide clear, complete documents to support every claim in your application.

Common documents include:

  • Passport identity page
  • Skills assessment outcome letter
  • English test results (e.g. IELTS, PTE Academic)
  • Employment references detailing duties, hours, and dates
  • Qualification certificates and transcripts
  • State or territory nomination approval (if applicable)
  • Evidence of eligible family sponsorship (if applicable)

You must also meet health and character requirements. This usually involves:

  • Completing a health examination
  • Providing police clearance certificates for each country where you have lived for 12 months or more in the past 10 years

If you include family members, you must provide identity, health, and character documents for them as well.

491 Visa Fees and Processing Times

The Subclass 491 visa requires payment of a visa application charge at the time of lodgement. The base application fee applies to the main applicant, with additional charges for adult and child dependants.

Extra costs may include:

  • Skills assessment fees
  • English language tests
  • Health examinations
  • Police certificates

Processing times vary based on application volume, completeness of documents, and individual circumstances. Well-prepared applications with complete documentation generally progress more smoothly.

The visa is granted as a 5-year provisional visa, allowing you and your family to live, work, and study in designated regional areas. After meeting residence and income requirements for at least three years, you may become eligible to apply for the Subclass 191 permanent residence visa.

Obligations and Conditions

You must meet strict location, employment and compliance requirements while holding the Subclass 491 visa. These conditions affect where you live, how you work, and what responsibilities apply to you and any family members included in your application.

Regional Living and Working Requirements

You must live, work and study only in a designated regional area of Australia for the duration of your visa.

This visa is valid for up to five years, and you cannot move to a non‑regional area unless your visa status changes. Designated regional areas include most locations outside Sydney, Melbourne and Brisbane, but you should confirm the current postcode classifications before relocating.

To become eligible for the Subclass 191 permanent residence visa, you must:

  • Hold the 491 visa for at least three years
  • Meet the required taxable income threshold for three income years
  • Comply with all visa conditions during that period

You can change employers without seeking further nomination approval. However, you must continue working in a regional area and in line with Australian workplace laws.
